Introduction
The access and use of the Treasured Memories Website "www.treasuredmemories.ie" (the “Website”) is subject to the acceptance, on behalf of the user, of the following conditions (the “Conditions of Use”) and applicable laws. By accessing and consulting the Website, the user accepts, without limitations or reservations, the Conditions of Use specified below. If the Conditions of Use are not accepted, the user will not be able to access the Website.

Services offered by the Website
The Website provides web-to-print services (collectively referred to as the “Services”), including customised printing of cards in various formats and on various materials (the "Products") with home delivery solely within the territory of the EU and United Kingdom with some exceptions. Unless specified otherwise, these Conditions of Use apply to all Services offered by Treasured Memories, where compatible. The provision of Services may be entrusted by Treasure Memories to third-party subcontractors or sub-suppliers.
Limitations to the use of content and information published on the Website
All information and content published on the Website (the “Information”) is protected by copyright or by other intellectual property rights and, except where indicated, cannot be used, neither in full nor in part, nor be copied, reproduced, transferred, published nor distributed in any way without the prior written consent of Treasured Memories. In any case, the user cannot distribute, edit, transmit, reuse, send or use the information, therein including texts, images, contents as well as software possibly present on the Website, for non-commercial, advertising or business purposes without the prior written authorisation of Treasured Memories.
Brands, logos and any other distinctive sign which appears on the Website are the property of Treasured Memories or its business partners, and cannot be used in any way or form or by any means without the prior written consent of Treasured Memories. In particular, the registered name “Treasured Memories”, as with any other distinctive sign which contains the “Treasured Memories” brand, cannot be in any way used as a domain name or as part of one, for third party sites, without the prior written consent of Treasured Memories.

As Treasured Memories evolves and changes over time, we may add or remove Products from our Website.
Treasured Memories will strive to publish precise and updated information on the Website. Nevertheless, there is no guarantee that the use of information does not violate the rights of third parties, nor that the information is free of errors, is exact, is complete or updated. Under no circumstances will Treasured Memories be held responsible in any way for any negative consequences, damages or losses, deriving or related to use of the Website and Information.
Sites, links and third party site contents
Treasured Memories cannot check the content of third party sites or of external pages to which the Website could be in some way connected, and does not assume any responsibility for materials and information shown on such sites in respect to those which Treasured Memories has a link to. Connecting to external pages from the Website is the responsibility of the user. Connection through link to other sites does not implicate in any way that Treasured Memories has a collaboration or affiliation with the third-party holders of these sites, such Facebook or Instagram.
Only connection to the home page of the Website is permitted to third parties. Under no circumstances is so-called deep linking permitted without the prior written authorisation of Treasured Memories.
Framing of the Website or parts of it by third parties is not permitted, nor is the use of any other medium which can lead users to believe that the Website contents are available to third parties. The inclusion of parts of the Website on third-party sites unknown to Treasured Memories is also forbidden.

Treasured Memories will give authorisation for the activation of the link to the Website at its own discretion, free of charge and in a non-exclusive manner.
Customer's journey
You must be at least 18 years old or otherwise have parent or guardian permission to use this Website. By using this Website, you represent and warrant that you are at least 18 years old or have that permission. In the event any provision hereof is found to be unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the extent necessary to allow enforceability of the provision as so limited, or, if a deemed modification is not satisfactory in the judgment of that court, the unenforceable provision shall be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected thereby.
It is the responsibility of users to have sufficient web, app and device usage skills to use our Services.
The information and details given on the Website should not be considered as offers: they are simply an invitation to users to do business by sending purchase orders. The proposal to purchase Products is formulated by the user at the moment the order form is sent in electronic format at the end of the procedure provided by the Website and described below:
- 1. After selecting the desired Product, the user can choose the pack quantity and the free gift described in the appropriate form on the Product page.
2. After customising the Product and confirming the design on the preview page, an order checkout screen will be displayed, showing the costs and total order value for all the selected Products and/or Services.
3. Then, the user promptly needs to authenticate himself using an email to proceed with the payment.
4. Once the order has been sent, the user will receive an order confirmation that describes the type of Products ordered, the price of each Product, the corresponding taxes, the shipping costs and the payment method chosen.
5. The contract is considered concluded and binding when Treasured Memories sends the order confirmation to the user at the email address she/he provided when registering on the Website.
Treasured Memories reserves the right, at its sole discretion, to refuse any order. The reasons for this may include (without limitation):
- the information provided by the user when filling in the order form being incomplete or incorrect;
- the user not meeting the requirements for the terms of payment;
- the Products ordered not being available.
In the examples listed above, Treasured Memories will inform the user by email that the order proposal was not accepted (in full or in part), specifying the reasons for the non-acceptance, and that the contract was not therefore concluded. In this case, Treasured Memories will reimburse to the user any sums the user has already paid.
Important: The user remains solely responsible for verifying the content, spelling and artwork of the uploaded files.
Your upload image files
Treasured Memories system automatically checks compatibility with regards to the format, dimensions, resolution and the presence of non-embedded fonts, checks the fonts and their conversion into paths, checks for any white overprinting or knockout, and converts Pantone colours to the best profile for the print requested (the system converts them directly to CMYK).
If the file is not compliant, the system will block the order. In this case, the user will be advised immediately via email and asked to upload a new file, with a resulting delay in the delivery date.
If the system does not reveal any problems, the file will automatically be sent for production.
Treasured Memories allows users to upload and store image file types such as JPG, PNG, GIF, TIF, BMP, PDF, AI and SVG. You can access those file images through the user's account – this is your "Image Storage". All Images must meet our image specifications, which we may change from time to time. Please visit our Recommendations page for further guidance and information on uploading images.
Treasured Memories offers users the ability to order:
- prints of their images;
- personalised Products and Services which bear users images on or within them;
- other non-personalised Products and Services,
- and we refer to those prints, Products and Services as our "Products".
Treasured Memories don't keep your files indefinitely - including your Images, all Product creations using your images and related user content from your account. So, unfortunately, we can't guarantee to store it once an order has been printed.
If you request a reprint of a previous card, we need to check if the artwork is still available; otherwise, you will have to send us the artwork again or recreate it. The user can request to remove all your Image Storage files permanently anytime by phone or email, and they will not be accessible to you anymore.
Important: your Image Storage with Treasured Memories must not be used as your primary or backup storage facility for your images. It is up to users to ensure that their images are securely stored elsewhere, as we do not guarantee that we will continue to make Image Storage available to you. Although we incur a cost in providing you with Image Storage, we don't charge for providing it.
Information sent by users
Any information, content or material sent to the Website (including uploaded files, data, questions, comments, suggestions or other) will always be kept confidential. The user guarantees to hold Treasured Memories harmless from any action, request, or demand put forward by third-parties in relation to the use of such material.
The users agrees not to submit any image or design that:
- is illegal or offensive (including anything of a defamatory, pornographic, or racially or ethnically objectionable nature); or
- infringes any copyright or other intellectual property rights.
Treasured Memories reserves the right, at any time, to stop any order which clearly breaches the intellectual property rights of third parties or which is defamatory, violent or otherwise contrary to public law and decency.
The selection of content and images to be printed, as well the obtaining of authorisation for their reproduction, where necessary, is the sole responsibility of users. Treasured Memories will not under any circumstances check content, apart from aspects related to the technical specifications and the artwork’s compatibility with the required specifications.
Treasured Memories cannot in any way be held liable for the unauthorised use of images by users or for any breach of third-party rights relating to them.
The user therefore releases, indemnifies and holds harmless Treasured Memories from any liability towards third parties for breach of intellectual property rights, damage to image, honour, decorum, moral integrity or any monetary or non-monetary damage resulting from the printing of images and content uploaded by the user.
The user hereby confirms their knowledge of the technical specifications provided on the Website in relation to the composition and permitted usage of the materials from which the Products are made, and undertakes to comply with them. The user assumes full responsibility in this regard, and therefore releases Treasured Memories from any responsibility, indemnifying it and holding it harmless, including with regard to pecuniary and non-pecuniary damages, for the user or third parties using the Products incorrectly or in a way that does not comply with their technical specifications.
Your templates and designs
To use our service, you will be required to generate artwork using our extensive range of images and frames available on this site. When you pay for your order, you pay for the physical items and not the artwork. All artwork will remain the property of Treasured Memories and can be deleted without notice. Any third-party images you use in your designs will remain your property, but we maintain the right to delete these without notice.
We have made every effort to make sure any images, logos or text copy used on this site are free from copyright. However, as you can use your photos, logos or text copy, we will assume you have the right to use these images. Any infringement on copyright laws may result in legal action on the part of the owners of these images.
You will be presented with digital proof of your designs before you can proceed to checkout. It is important you check these carefully and make sure you are happy to proceed before payment is made. We can not be held responsible for mistakes you have made while generating your design, so it is imperative you check the quality of your images, colours, spellings, dates or any other information you have input into the design.
Choosing a good quality image is very important. Although a digital image may look okay on the screen, it can often not print. We have a tutorial on the site to explain this in detail. We will not be responsible if you are not happy with the quality of the images you have chosen.
When choosing colours within your designs it is important to note that different digital displays and screens may show the colours differently. This depends a lot on the quality of your monitor or screen and how it has been calibrated. Therefore, we cannot be responsible if you are not happy with your particular colours.
Your artwork will be held for at least 365 days. If you would like to re-order after this period, we may contact you to ask you if you wish us to continue to hold it on your behalf.
User registration and terms of payment
Each user can register on the Website, by inserting their data on the appropriate registration form, if the client intends to proceed to the purchase of Products sold through the Website. The user guarantees Treasured Memories that information provided during registration is current, sincere and correct, and will undertake to notify Treasured Memories of any variation in data regarding the registration. Notification must be carried out by editing the personal account. In the event that Treasured Memories should believe that the information is not correct, or for any reason believes that such a measure is justified, it will be able to deny access to the Website or suspend the user’s account. Treasured Memories will proceed with verifying the VAT number only for professionals/businesses who have offices in the European Union.
Our prices can be viewed in Euros or Pound Sterling. All card orders include free or paid design, free white 100gsm envelopes, delivery costs, a non-personalised free gift and VAT. We reserve the right to revise prices without notice, however all orders will be delivered at the price displayed to the customer at the time of ordering.
All pricing on this site includes VAT charged at the local rate of 21%, although the vat is not shown on the site until you get to the shopping cart. VAT receipts will be issued by email after payment is made in full.
We accept Amex, Apple Pay, Google Pay, Mastercard, Maestro, Paypal, Shop Pay and Visa. Treasured Memories use Shop Pay & Paypal secure payment gateway system to process customers transactions. At payment stage you will be linked to a secure gateway system to process your credit/debit card details and confirm your order. Your bank statement will display your payment to Keeco Creative Limited. Keeco Creative Limited is the parent company of Treasured Memories.
Errors
When you personalise your chosen card design you will see an on-line PROOF of your card. It is your responsibility to check your final design carefully. If you approve a design that has wrong information, typos, spelling mistakes, we will not provide a refund. Our Website has an automated ordering process once the order has been confirmed and paid for, we regret that we are unable to make amendments to the cards, cancel or refund an order.
We endeavour to provide customers with high quality printed personalised cards. Our cards are printed on the latest digital printing machines to ensure a professional high quality Product is produced. Please note there are certain factors which are outside our control. Variations in Computer/Tablet device personal settings may mean the card preview on screen may have slightly different tonal representations from our printing Product
The quality of the photo uploaded by our customers is also outside our control. Treasured Memories will not be held liable by users for damages of any kind, whether direct or indirect, deriving from possible errors, of any type, in the printing of the file sent by the user, except in the case of wilful misconduct or gross negligence.
In the event of printing errors not attributable to the user or delivery of a defective or damaged Product, Treasured Memories will be obliged to carry out just one reprint of the material.
Users that qualify as consumers can ask Treasured Memories, within the time limit set out by the applicable consumers’ law, to provide the remedies provided by the Consumer Code for any defects in the Products existing at the time the goods are delivered.

Bespoke Design Service
The User can ask Treasured Memories, following payment of a fee, to provide a Bespoke Design Service, comprising the revision or creation of graphics files for printing, as described in more detail below:
- 1. The User contacts Treasured Memories Bespoke Design Service by phone, email, or by filling the We can Design For You page form. Unless otherwise indicated by the User, Treasured Memories will make contact through the previously provided email address or telephone number. Without prejudice to the preceding, Treasured Memories may, in any case, decide to also arrange screen-sharing sessions via 'Zoom' (or similar applications) with the User to provide the Bespoke Design Service more effectively. The User should describe their Product in as much detail as possible, always including the exact text and design specifications they would like to see incorporated into the design, such as the colours, style, effect and dimensions of their desired Product. The User can also send images in JPG, PNG, GIF, TIF, BMP, PDF, AI or SVG format as reference material or as content for Treasured Memories to further develop or incorporate into its work.
2. Based on the User's instructions, Treasured Memories will send the design proposal to the User's email address that provides the price based on the complexity of the ideas and the expected amount of time that it takes.
3. The User must pay a fee plus applicable VAT using the various payment methods indicated by Treasured Memories and following the instructions provided in the purchasing process.
4. Throughout its entire duration, the Bespoke Design Service includes a maximum of three revisions by the Treasured Memories designer, based on their feedback. It is understood that, once the Design Service has provided three revisions, Treasured Memories obligations in this regard shall be considered to have been fulfilled and new fees can be requested from this moment to made further changes.
5. The content will remain available for the User to access for the entire period they are registered with the Website, without prejudice to their right to request its deletion, which can be exercised in writing by sending an email to hello@treasuredmemories.ie or a letter to the following address: Unit E16, South City Business Park, Whitestown Way, Tallaght, Dublin 24, D24 HH48, Ireland.
Since the activities covered by the Bespoke Design Service include artistic work, the obligations assumed in this regard by Treasured Memories must be considered relative rather than absolute obligations, and therefore Treasured Memories cannot be held liable for the User's dissatisfaction once the three revisions have been undertaken, with the understanding that Treasured Memories will do everything it can to satisfy the User's requests.
All rights to use the graphic design created by the Bespoke Design Service will remain with the User, without prejudice to Treasured Memories' moral rights as the creator. Treasured Memories will not conduct a prior art search and/or check whether the images are already in use by third parties when producing the design proposal, and therefore it does not guarantee either the originality or exclusivity of the graphic design made by the Bespoke Design Service. It is the User's responsibility to check that the rights of third parties are not infringed before using the design proposal created by the Design Service, and the User, therefore, releases Treasured Memories from any liability in this regard.
In all cases, Treasured Memories reserves the right to alter or to refuse to carry out work on the order when it believes the file received from the User and/or the graphic design content they have requested breaches the intellectual property rights of third parties or is defamatory, violent or otherwise contrary to public policy and morality.
It is understood that the selection of content and images to be printed and obtaining legal authorisation for their reproduction, where necessary, is the sole responsibility of Users. Treasured Memories cannot in any way be held liable for the unauthorised use of images by Users or for any breach of third-party rights relating to them. The User, therefore, releases, indemnifies and holds harmless Treasured Memories from any liability towards third parties for claimed violations of intellectual property rights, damage to image, honour, decorum, moral integrity or any monetary or non-monetary damage resulting from the printing of images and content uploaded by the User.
Report security vulnerabilities

So that we may more effectively respond to your report, please provide any supporting material (proof-of-concept code, tool output, etc.) that would be useful in helping us understand the nature and severity of the vulnerability.
The information you share with Treasured Memories as part of this process is kept confidential. Treasured Memories will only share this information with a third party if the vulnerability you report is found to affect a used third-party technology, in which case we will share this information with the third-party code's author or company. Otherwise, Treasured Memories will only share this information as permitted by you.

Treasured Memories reserves the right to revise, amend or simply update, in whole or in part, at its exclusive discretion, in any manner and/at any time, without prejudice, this Conditions of Use, due also to the amendment of legal or regulatory provisions in the field of personal data protection. As appropriate, the amendments and updates to the Conditions of Use will be notified to the users by:
